Wage advance regulations in Vietnam: What workers and businesses need to know

It is entirely normal for a worker to need money before payday — hospital fees, a child's tuition, an urgent payment due. But "whether you can get an advance, how much, and whether you must repay it" depends on which case applies under the law.

A worker may receive a wage advance under conditions agreed by both parties and without interest. Beyond the agreement case, the 2019 Labor Code also prescribes certain specific situations relating to the performance of civic duties, annual leave, piecework or contracted work lasting several months, and periods of work suspension. The conditions, advance amount and repayment obligation are not the same in every case.

Wage advance regulations for workers and businesses in Vietnam

The article below summarizes the general regulations in force and suggests how a business can build a transparent advance process. The content is for general legal information and does not replace advice for a specific case.

What is a wage advance?

A wage advance is when a worker receives, in advance, an amount related to their wages before the point at which the business must pay under the usual schedule.

An advance may arise from: an agreement between the two parties; a case where the law requires the employer to give an advance; the nature of work lasting several months; or a period during which the worker's work is suspended.

A wage advance does not increase the total wages the worker is entitled to. The amount received in advance must be recorded and processed when the business determines the amount still payable.

Legal basis for wage advances

The key provisions are in the Labor Code No. 45/2019/QH14, including:

  • Article 97: The wage payment schedule, including the case of piecework or contracted work that must be done over several months.

  • Article 101: Wage advances by agreement, when performing civic duties and when taking annual leave.

  • Article 128: Work suspension and the advance during the suspension period.

A business should also consider Decree No. 145/2020/ND-CP, the labor contract, the collective labor agreement, the wage-payment regulations and other relevant rules.

The cases in which a worker may receive a wage advance

The wage-advance cases under the 2019 Labor Code

1. Advance by agreement between the two parties

Clause 1, Article 101 of the 2019 Labor Code provides:

> A worker may receive a wage advance under conditions agreed by both parties and without interest.

This is the most common case in businesses. A worker may request an advance for personal needs such as hospital fees, tuition, vehicle repair, living expenses or an unexpected event. However, making a request does not mean the business is obliged to approve it in every situation.

The two parties may agree on: the conditions for an advance; the maximum amount; the number of advances within one pay period; the timing of payment; how the amount received is recorded and reconciled; and the documentation, confirmation method and responsibility when there is a discrepancy.

Is a business obliged to allow an advance for personal needs? Not automatically. For an advance under Clause 1, Article 101, this is carried out on the basis of agreement. A business may approve, decline, or approve only part, according to its own regulations and capacity, as long as this does not conflict with existing commitments in the contract, the collective agreement or the applicable regulations.

2. Advance when the worker performs a civic duty

Clause 2, Article 101 provides that the employer must give the worker a wage advance when the worker temporarily takes leave from work to perform a civic duty of 1 week or more.

The advance corresponds to the number of days the worker is temporarily on leave, up to a maximum of 1 month's wages under the labor contract.
Note on the enlistment case: a worker enlisting under the Law on Military Service does not fall within the advance case under this provision. A business needs to distinguish "performing a civic duty" from "military enlistment" in order to apply the rule correctly.

3. Advance when taking annual leave

Clause 3, Article 101 provides that, when taking annual leave, a worker may receive an advance of at least the wages for the days of leave.

Example: a worker takes 5 days of annual leave, and the corresponding wages for those 5 days are 2,000,000 VND; then the minimum advance under the regulation is 2,000,000 VND. The business needs to determine the wages for the days of leave according to the regulations and the worker's actual records at the time of processing.

4. Piecework or contracted work lasting several months

Clause 3, Article 97 of the 2019 Labor Code provides that a worker paid by piece or by contract is paid according to the agreement; if the work must be done over several months, then each month the worker receives a wage advance based on the volume of work done during the month.

In this case, the advance is tied to the volume of work performed, the agreed piece rate or contract price, and the acceptance result or confirmation by the business.

Example: a contracted job is expected to be completed in 4 months; at the end of the first month, the business confirms that the worker has completed 20% of the volume; the monthly advance is determined based on the completed portion of the work and the parties' agreement.

5. Advance during a period of work suspension

Under Article 128 of the 2019 Labor Code, during a period of work suspension, the worker may receive an advance of 50% of the wages preceding the suspension.

After the outcome is determined: if the worker is not subject to labor discipline, the employer pays the full wages for the period of suspension. This is a case with its own rules and should not be handled the same as an advance for personal needs.

Is a wage advance subject to interest?

No. Clause 1, Article 101 provides that a wage advance is made under conditions agreed by both parties and without interest. A business should not use a wage advance as an internal interest-bearing loan to the worker.

However, one must distinguish interest (an amount charged for the use of capital over a period of time) from a service fee (a charge for providing a platform, transferring money, or processing the transaction, if the model so provides).

If an early-wage program has a fee, the business must clearly determine the nature of the fee, who collects it, how it is calculated, and the duty to disclose it before the transaction. Calling a charge a "fee" does not automatically make it acceptable if its nature resembles a cost of using capital or if it is not transparent.

What is the maximum advance amount?

There is no single maximum applicable to all cases:

  • By agreement: the advance amount is agreed by the two parties; the business may set a rate or limit appropriate to the wages already earned, the ability to reconcile, and operational risk.

  • Performing a civic duty: corresponding to the number of days temporarily on leave, up to a maximum of 1 month's contract wages.

  • Annual leave: at least the wages for the days of leave.

  • Work suspension: 50% of the wages preceding the suspension.

Therefore, when answering "how many months' wages can be advanced at most?", you must determine which case the worker falls under.

Must the worker repay the advance?

The obligation to handle the amount received depends on each case:

  • By agreement: carried out under the agreed conditions, usually reconciled against the wages due.

  • Performing a civic duty: the worker must repay the amount advanced under Clause 2, Article 101.

  • Annual leave: the amount received in advance is counted in paying the wages for the relevant period.

  • Piecework/contract over several months: reconciled according to the volume and result of the work.

  • Work suspension: the specific rules in Article 128 apply.

The same repayment-commitment template should not be used for every case.

Is a wage advance the same as a wage deduction?

Two concepts need to be distinguished:

  • Reconciling the amount received in advance: determining the amount the worker has received and the amount the business still has to pay in the period.

  • Wage deduction: the employer withholding wages in the cases permitted by law, with its own principles and limits.

When building the process, a business should clearly describe the advanced amount as a portion of wages received in advance and how it is reconciled into the pay period, avoiding inaccurate terminology or self-imposed penalties.

May a business decline an advance request?

It may decline when this is merely a request by agreement: if a worker requests an advance for personal needs and the business has no mandatory commitment, the two parties must agree; the business may not approve, or may approve only part.

It should not decline arbitrarily where the law prescribes a specific responsibility: for the cases of performing a civic duty, annual leave, piecework/contract lasting several months, or work suspension, the business must accurately check the conditions and act according to the corresponding regulations.

What should the wage-advance documentation include?

The law does not require every case to use the same form. However, for transparency and easy reconciliation, a business should keep: the worker's full name and code; the department or unit; the case/basis for the advance; the amount requested and the amount approved; the request date, approval date and payment date; the pay period expected for reconciliation; the conditions for repayment or handling of the amount received; a service fee, if any, in a digitized model; the approver and transaction status; and the worker's confirmation in writing or by an appropriate electronic method.

For an EWA system, the above data can be recorded automatically through transaction history and system logs.

Proposed wage-advance process for a business

  1. Identify the legal case: classify the request as by agreement, civic duty, annual leave, piecework/contract, or work suspension.

  2. Check the data: cross-check the contract, wage rate, days worked, days of leave, work volume and the amount received in advance.

  3. Determine the amount and authority: correctly compute the advance for each case and identify who has the authority to approve.

  4. State the conditions clearly: the worker needs to know the amount to be received, the timing of payment, how it is reconciled, the repayment obligation and any fee.

  5. Pay and keep records: carry it out through the agreed method; keep the transaction ID, records and the approver.

  6. Reconcile into the pay period: record the amount paid in advance, determine the remaining wages, and state it clearly on the pay statement.

  7. Handle exceptions: have a separate process for time-tracking errors, failed transactions, resignation, insufficient wages, duplicate transactions or complaints.

What should a wage-advance policy cover?

A business should at minimum provide for: the scope and subjects of application; the advance cases; the conditions for requests by agreement; the minimum, maximum or advance rate; the number and timing of requests; the approval authority; the processing time and payment method; how to reconcile or repay; a service fee, if any; handling on resignation, time-tracking errors or insufficient wages; the responsibility to protect data; and a mechanism for complaints and correcting errors.

The policy needs to be consistent with the labor contract, the collective labor agreement and the business's other wage policies.

How do a wage advance and EWA differ?

A traditional advance is usually handled request by request and may pass through several levels of approval. EWA digitizes this process by connecting time-tracking and payroll data to determine the portion of wages already earned that is eligible.

EWA is not automatically governed by a single provision on wage advances. A legal study published in the Banking Review in 2026 notes that Vietnam does not yet have a dedicated legal regime for EWA; the nature of the model needs to be examined through the transaction structure, the source of funds, the right of recourse, the costs and the personal data.

What should a business note when deploying Earned Wage Access?

  • Only compute the limit on sufficiently reliable time-tracking data.

  • Distinguish wages already earned from income expected in the future.

  • Do not charge interest on a wage advance.

  • Clearly disclose all fees before the worker confirms.

  • Do not allow amounts beyond what can be safely reconciled.

  • Clarify the source of funds and who bears the risk.

  • Have an agreement/policy on how to handle the amount received.

  • Display the expected remaining amount for the pay period.

  • Protect time-tracking, wage and payment-account data.

  • Have a process for resolving complaints and discrepancies.

Conclusion

Wage-advance regulations are not a single case. An advance for personal needs is based on agreement and without interest. In addition, the law prescribes separate responsibilities and handling for civic duty, annual leave, piecework or contracted work lasting several months, and periods of work suspension.

A business needs to classify the case correctly before determining the amount, the repayment obligation and the reconciliation process. FAQ

If a worker asks for an advance, must the business agree?

If it is merely a personal need under Clause 1, Article 101, the advance is based on agreement. The business is not automatically obliged to approve every request, unless it has a commitment or the worker falls within a case specifically prescribed by law.
